BAC RESOLUTION NO. 26 S. 2021 – RECOMMENDING THE AWARD OF CONTRACT FOR THE MUSEUM MAINTENANCE AND RESTORATION OF THE MUSEUM OF PHILIPPINE ECONOMIC HISTORY (MPEH)
WHEREAS, The National Historical Commission of the Philippines Bids and Awards Committee (NHCP-BAC) invited qualified companies to bid for Museum Maintenance and Restoration of the Museum of Philippine Economic History (MPEH), with a total Approved Budget Cost (ABC) of Two Million Eighty One Thousand One Hundred Eighty Six and 33/100 Pesos only (₱ 2,081,186.33) through its advertisements on PhilGEPS, a newspaper of general circulation, and via notices posted at the NHCP premises and at the NHCP website on 12-19 August 2021;
WHEREAS, two (2) companies, namely J.S. Lim Construction & Trading and Micro-Asia Builders Corporation have signified their interest to participate in the bidding and submitted their technical and financial proposals accordingly;
WHEREAS, the submitted sealed bids were opened on 1 September 2021, 9:00 AM, at the NHCP Central Office in Manila, with representatives from each company observing the proceedings via online videoconferencing;
WHEREAS, upon the opening of their submitted bids by the NHCP-BAC, the two bidders, all of which were determined as compliant with all criteria for post-qualification, have submitted the following bid prices:
- S. Lim Construction & Trading ₱ 1,762,606.57 (discounted from ₱ 2,073,654.79)
- Micro-Asia Builders Corporation ₱ 1,858,548.91
WHEREAS, after evaluation and post qualification, the company with the lowest bid price, J.S. Lim Construction & Trading has inconsistencies and error in their arithmetical computation on the bill of quantities submitted.
WHEREAS, upon BAC Technical Member arithmetical computation of the submitted financial document of J.S. Lim Construction & Trading, the following results are as follows:

NOW THEREFORE, upon unanimous decision and approval of the NHCP-BAC during its 8 September 2021 deliberation, be it
RESOLVED, AS IT IS HEREBY RESOLVED, that the project contract for the Museum Maintenance and Restoration of the Museum of Philippine Economic History (MPEH), be awarded to J.S. Lim Construction & Trading with the amount of One Million Seven Hundred Fifty Seven Thousand Eighty One and 57/100 pesos only (₱ 1,757,081.57).

Please be informed of the following additional information and clarifications:
1. The submission of a Performance Securing Declaration (PSD) by the winning bidder in lieu of a Performance Security Bond (a mechanism originally provided for by the Guidelines on the use of a Framework Agreement as adopted by Resolution No. 12-2017 and subsequently revised by Resolution No. 27-2019 by the Government Procurement Policy Board or the GPPB), is allowed and encouraged in light of the ongoing COVID-19 pandemic, pursuant to Resolution No. 09-2020 as approved by the GPPB on 7 May 2020 (Approving measures for the efficient conduct of procurement activities during a State of Calamity, or implementation of Community Quarantine or similar restrictions) considering limited access to financial institutions, regulatory and other offices, as well as the implementation of government restrictions on transport and travel. However, the same Resolution also stipulates that the end-user (procuring entity) may require the posting of an actual Performance Security Bond upon the lifting of the aforementioned restrictions, subject to its own evaluation of the circumstances.
Upon unanimous decision, the NHCP-BAC as the procuring entity requires the winning bidder to submit a Performance Security Bond upon the receipt of Notice of Award.

- The National Historical Commission of the Philippines (NHCP), through the General Appropriations Act 2021 (GAA) intends to apply the sum of Php 2,081,186.33 being the Approved Budget for the Contract (ABC) to payments under the contract for:
Museum Maintenance and Restoration of the Museum of Philippine Economic History (MPEH) in J.M. Basa St. Cor. Ortiz St., Iloilo City
Bids received in excess of the ABC shall be automatically rejected at bid opening.
- The NHCP now invites bids for Museum Maintenance and Restoration of the Museum of Philippine Economic History (MPEH). Completion of the Works is 120 calendar days. Bidders should have completed a contract similar to the Project. The description of an eligible bidder is contained in the Bidding Documents, particularly, in Section II. Instructions to Bidders.
- Bidding will be conducted through open competitive bidding procedures using non-discretionary “pass/fail” criterion as specified in the 2016 Revised Implementing Rules and Regulations (IRR) of Republic Act 9184 (RA 9184), otherwise known as the “Government Procurement Reform Act.”
Bidding is restricted to Filipino citizens/sole proprietorships, cooperatives, and partnerships or organizations with at least seventy five percent (75%) interest or outstanding capital stock belonging to citizens of the Philippines.
- Interested bidders may obtain further information from NHCP and inspect the Bidding Documents at the address given below from Monday to Friday, 8:00 A.M. to 4:00 P.M.

NHCP Human Resource Management Information System (Direct Invitation)
- The National Historical Commission of the Philippines (NHCP), through the General Appropriations Act 2021 intends to apply the sum of Php 2,100,000.00 being the Approved Budget for the Contract (ABC) to payments under the contract for NHCP Human Resource Management Information System (HRMIS). Bids received in excess of the ABC shall be automatically rejected at the opening of the financial proposals.
- The National Historical Commission of the Philippines (NHCP) now calls for the submission of eligibility documents for NHCP Human Resource Management Information System (HRMIS). Eligibility documents of interested consultants must be duly received by the BAC Secretariat on or before 17 June 2021, 9:30 A.M. at Records Section, Ground Floor, NHCP Building, T.M. Kalaw Street Ermita, Manila. Applications for eligibility will be evaluated based on a non-discretionary “pass/fail” criterion.
- Interested bidders may obtain further information from National Historical Commission of the Philippines and inspect the Bidding Documents at the address given below during 8:00 a.m. to 5:00 p.m.
- A complete set of Bidding Documents may be acquired by interested Bidders on 21 June 2021 from the address below and upon payment of the applicable fee for the Bidding Documents, pursuant to the latest Guidelines issued by the GPPB, in the amount of Php 5,000.00. - The BAC shall draw up the short list of consultants from those who have submitted Expression of Interest, including the eligibility documents, and have been determined as eligible in accordance with the provisions of Republic Act 9184 (RA 9184), otherwise known as the “Government Procurement Reform Act”, and its Implementing Rules and Regulations (IRR). The short list shall consist of at least three prospective bidders who will be entitled to submit bids. The criteria and rating system for short listing are:

- Bidding will be conducted through open competitive bidding procedures using non-discretionary “pass/fail” criterion as specified in the IRR of RA 9184.
Bidding is restricted to Filipino citizens/sole proprietorships, cooperatives, and partnerships or organizations with at least sixty percent (60%) interest or outstanding capital stock belonging to citizens of the Philippines.
- The Procuring Entity shall evaluate bids using the Quality Based Evaluation/Selection (QBE/QBS) The criteria and rating system for the evaluation of bids shall be provided in the Instructions to Bidders.
- The contract shall be completed within ninety (90) calendar days.
- The National Historical Commission of the Philippines reserves the right to reject any and all bids, declare a failure of bidding, or not award the contract at any time prior to contract award in accordance with Section 41 of RA 9184 and its IRR, without thereby incurring any liability to the affected bidder or bidders.
